Anthony's defense motion to exclude any mention of the stain, prosecutors said it is evidence that the child's body decomposed for several days




ORLANDO, Fla. -- Prosecutors filed new court papers Friday addressing a stain found in Casey Anthony's car trunk.



Attorneys with Anthony's defense said they wanted any mention of the smell in her car disallowed. They said investigators mishandled trash that had been in the trunk.

The smell in the car and the stain in the trunk are key pieces of the state's argument that Anthony knowingly drove around with the body of her daughter, Caylee Anthony, in the trunk and has knowledge of what happened to her.

In a response to Anthony's defense motion to exclude any mention of the stain, prosecutors said it is evidence that the child's body decomposed for several days before Casey Anthony dumped it in the woods.

For their part, Anthony's defense filed a motion accusing the state of deliberately mishandling several empty containers, including a pizza box found inside a trash bag taken from the trunk.

The defense accused investigators of letting the trash air out, so it would not smell the same to jurors in Casey Anthony's upcoming murder trial.

One source close to the investigation said on Friday that position is "laughable."

The defense is asking that, based on the mishandling of the trash, any mention of the so-called smell of death in the car should also be excluded.

Judge Belvin Perry ruled on Thursday that evidence of Casey Anthony's alleged history of lying, her tattoo purchase, her MySpace postings and testimony that she never told her boyfriend that Caylee was missing should all be included as state's evidence in the trial.

(WOFL FOX 35) - It has now been two years since Haleigh Cummings went missing. Investigators say she was kidnapped from her Satsuma home in Putnam County the night of February 9, 2009. She was 5-years-old at the time.

Haeligh's father, Ronald Cummings, was dating Misty Croslin at the time. Croslin says she put Haleigh to bed at around 7:30 at night, but when she went to check on her she says she was gone.

A massive search was conducted by police and an Amber Alert was issued but she was never found.

Two years later, investigators still don't know where Haleigh is, but they do think that Misty Croslin might know more than she's telling.

Both Croslin and Cummings are in priosn. In October Croslin was sentenced to 25 years in prison after entering a no-contest plea to a charge of trafficking in oxycodone, to be followed by 5 years of drug offender probation and payment of a $500,000 fine. Croslin was arrested in January 2010 following an undercover operation that resulted in five arrests.

Ronald Cummings was also charged in the same undercover sting and took a plea deal and agreed to a 15-year sentence. Cummings was also fined $250,000. As part of the plea agreement Cummings also agreed to testify for the state in future litigation involving his missing daughter.

Police, friends and neighbors of a New Braunfels couple searched the area for a missing toddler Saturday.

The family said the boy disappeared from their home Friday night, New Braunfels Police Lt. Mike Penshorn said.

Police got a call just after 8:30 p.m. Friday from the child's parents saying the small boy was gone.

Penshorn said the couple last saw 18 month-old Joshua Davis inside their home about 20 minutes before they called police.

Officers searched the home, then began a sweep of the neighborhood.

They searched surrounding homes and called in a Department of Public Safety helicopter to scan the area, but could not find the child, Penshorn said.

The searched continued for little Joshua Saturday afternoon.

Police say he is 2-feet tall and weighs 30 pounds.

New Braunfels Texas toddler is still missing

The search for 18-month-old Joshua Davis is still ongoing. He was reported missing around 8:00 p.m. last Friday from his home in New Braunfels, Texas.

The Braunfels Police Dept., volunteers and search parties have been searching for him non stop.

"He's still out there. Don't give up looking for him, anyone. If you don't want us to show your face, drop him off somewhere, anything, so he could be back at home with us," said Joshua's mother, Sabrina Benitez.

Joshua's mom believes he has been abducted, but the police dept has ruled out foul play, and believe he wandered away from his home on Savannah Hill Circle.

There was a rumor that he had been found at a trailer on Hunter Road about 10 miles away, but that was a false report.
Mother states that Joshua unable to open a door.

NEW BRAUNFELS - State and federal law enforcement agencies have been consulted in the case of little Joshua Jayvaughan Davis, Jr., the New Braunfels toddler missing since Friday from his Savannah Hill Circle home.

Texas Rangers are assisting with the investigation and the first of several K-9 units has been brought in to aid with the ground search. Joshua, 18 months old, was reported missing at 8:38 p.m. Friday.

The Federal Bureau of Investigation has been consulted on the case and is helping with the investigation, said New Braunfels Police Department spokesman Lt. Michael Penshorn.

NEW BRAUNFELS, Texas -- Relatives of a missing New Braunfels toddler said police are asking them to undergo polygraph tests in an effort to locate the 18-month-old boy.

Joshua Davis Jr. was reported missing by his parents, who told police they last saw their son around 8 p.m. Friday inside their home in the 2600 block of Savannah Hill Circle.

Police, along with other law enforcement agents and volunteers, combed a wooded area near the family's home all weekend but did not locate him.

Late Sunday, police declared the effort a "recovery mission," indicating they were losing hope that he might be found alive.

One of the ideas that police are exploring is that Joshua wandered away from his family's home. They said that if that happened, the chances of him surviving outdoors all night in the chilly temperatures were not good.

Police, however, said they will keep up their efforts to find out what happened to the toddler.

"We're going to be retracing some of our steps," Lt. Mike Penshorn said Monday morning.

"Also, we are still interviewing a number of the people associated with the child and, of course, we're expanding that where we have quite a few people that we are bringing just to talk to find out what did happen in this case."

According to Jerome Davis, Joshua's grandfather, that also includes administering polygraph tests to everyone who lives in the household.

False hope and sadness: Joshua Davis remains missing


SAN ANTONIO -- On Sunday, a mother and father went to bed with their toddler missing for a third straight night.

It was an emotional day for the parents of Joshua Davis, Jr. First, authorities reported that their missing son might be dead. Then rumors surfaced that the boy was found. However, this ended up being false news.

“I went to sleep and all I could hear was my baby crying and calling for mommy,” Sabrina Benitez said.

Frigid cold and rugged terrain diminished rescuers hopes of finding an 18-month-old who had been missing for two days, and a police spokesman said Sunday the search effort had turned into a recovery mission.

Signs suggest Joshua Davis wandered out of his New Braunfels home in the Texas Hill Country on Friday evening, New Braunfels police Lt. Michael Penshorn said. There was no evidence of abduction. Police searched the home several times and went house to house in the area, a police statement said.

On Sunday, they brought in "cadaver" dogs to help find the child, Penshorn said. The dogs are trained to detect dead bodies.

Two nights of temperatures as low as 20 degrees have passed, and if Joshua spent them in the wooded area around his family's home, "there's little chance that he could have survived those conditions," Penshorn said.

The area around the mobile home park where the family lives ranges from grassy to wooded, and Penshorn said a small child would not likely be visible to searchers even if a few yards away.

At a press conference this afternoon New Braunfels Police Lieutenant Michael Penshorn brought us up to date on the search effort, which includes personnel from the Alamo Area Search and Rescue, Travis County Search and Rescue and Search Dog Rescue from College Station. Overnight searches were conducted on the ground by uniformed officers and in the air with the assistance a Texas DPS helicopter, and today about one hundred volunteers were mobilized at Klein Road Elementary School and added to the professional force. Police say child is very mobile and it is conceivable that he left the house on his own and took off running, covering a short area in a short period of time.

Throughout the evening, the glass front door was open.

Joshua was last seen in family's double-wide kitchen dining area with five or six family members.

Front glass door did not latch properly, police said.

Sex offender across the street is not a suspect, but his home has been searched to nothing available.

4 P.M. UPDATE: Joshua Davis is still missing

New Braunfels Police say 18-month-old Joshua Davis still has not been found. The volunteer search site at Klein Road Elementary will be shut down at 6 p.m. today, but uniform officers will continue looking for the child.

A search party of 100 volunteers is looking for Joshua, who has been missing since Friday night.

Police say child is very mobile, and it is conceivable that he left the house in the 2600 block of Savannah Hill Circle on his own and took off running, covering a short area in a short period of time.

Amber Alert was issued for infant Keith Squaire, age 16 months. He was last seen in the company of Keith Squaire about 9 p.m. Tuesday in the area of the Century Woods Apartments at 20 West Highway 4.

The kidnapping reportedly happened in the City of Pensacola Tuesday night. The vehicle believed to have been used in the kidnapping was later located in Brewton, where the driver told Brewton Police that the suspect and baby were dropped off at a residence near Century Woods.

The Escambia County Sheriff’s Department unsuccessfully checked several possible suspect locations including homes on Blackmon Street and West Highway 4 Tuesday night in an effort to the find the child.

The infant Keith Squaire was last seen wearing a burgundy and white jumpsuit, brown boots and has braids in his hair. The young black male is about two-feet eight-inches tall, weighs 27 pounds and has black hair and brown eyes. A photograph of the child was not available.

The suspect Keight Squaire was described as being a black male, 37-years old, five-feet ten-inches tall, 235 pounds, with black hair, brown eyes. He was last seen wearing a white t-shirt and blue jeans.

Indianapolis — An Indianapolis mother says a prayer of protection for her baby's safe return. Loved ones and supporters joined Sandra Young for a gathering of hope outside the Statehouse Saturday afternoon.

Jacob was eight-months-old when Young says the boy's father, Maurice Young, took him. The two were last spotted at a homeless shelter in Atlanta.

Indiana authorities issued an Amber Alert for Jacob about a month after his disappearance. The FBI is now involved in the search.

Wrapped presents still sit untouched underneath the tree, awaiting little Jacob Young who never celebrated his very first Christmas.

Jacob's father Maurice Young took Jacob to run errands Dec. 23, just one day after Sandy Young told him she wanted a divorce. But when his text messages abruptly stopped, she said knew something was horribly wrong.

"I found the numbers for Nashville and knew that he was probably gone," Sandy said.

She said called that number and was connected to a homeless shelter in Nashville, TN.

"I jumped in my car and I just started driving."

When she arrived, her suspicions were confirmed.

"The officer came and confirmed that he was there with Jacob and called me and said, 'you don't have a court order, legally there's nothing I can do," she said.

But Sandy's attorney disagrees.

Since the baby was born out of wedlock, state law says the biological mother has sole custody.

When Sandy filed a petition for her child to be immediately returned, she hit another road block.

"I have information that he's not even with his dad. Maurice has been spotted with Jacob in Atlanta, and then spotted Friday and Saturday without him in Atlanta. I don't know if he's dead or alive," she said.

Panicked, Sandy said she contacted police again.

"Missing persons still refused to take a report. I feared for Jacob's safety and the police came and told me again...its civil quit calling us," Sandy said.

Taking matters into her own hands, Sandy created fliers giving them to anyone who would listen.

She said she is desperate and wondering why the system is failing her.

"Why is there an eight-month-old baby who cannot protect himself and no one cares about where he's at or whether he's safe? Why is that?," she said.

Sandy said she has been asking those questions for nearly a month.

Questions she said she'll continue to ask until her son is safe, back in his own bed, in his own home, opening Christmas presents from Santa.

"I'm very desperate. I just want Jacob home. I want to know that he's safe. And I need some help. I've done everything that I can do," she said.

Sandy's petition for the immediate return of her child and a petition to establish temporary sole custody have both been denied.

She has a hearing in court this Thursday to fight that ruling.

Adams and Casey exchanged letters while she was in the Orange County jail before she was convicted on drug charges and sent to federal prison. Adams told detectives in the interview that Casey told her she was abused.

Adams told investigators that Casey claimed to have been abused when she was younger, at the hands of her brother and father.

Adams saved her letters and shipped them to a friend on the outside. Adams, a convicted drug dealer, and currently in state prison, told investigators about how she built up a friendship with Casey. They traded letters by stuffing them in books inside the jail.

Adams painted the picture of Casey as someone upset with her family.

"I think I was just the one that was there. She didn't have anybody else. She felt like even her family turned on her," Adams told detectives.

Adams told investigators Casey felt betrayed by her mother, Cindy Anthony, who was doing talk shows, instead of going to her court hearings. She said Casey opened up about her childhood, sometimes in conversation, but mostly in letters.

When asked about sexual abuse, Adams told investigators Casey claimed she suffered the abuse at the hands of family members when she was young.

"She was younger, as if she went through a lot with her brother, a lot with her dad," Adams said.

As for the mystery baby sitter Zenaida Gonzales, who Casey claimed took her daughter Caylee, Adams said: "There was no Zenaida."

The investigator then asked, "Ok, did she tell you that?"

"Zenaida was a childhood friend," Adams replied.

There is also information on the internal investigation into corrections officer Silvia Hernandez. Hernandez helped Casey communicate with Robyn Adams.

Someone needs to hang her from her knees and beat her!

NORTH CHARLESTON, SC (WCSC) - The toddler who North Charleston police say was hanged by his ankles and beaten in November is not expected to have any long term physical effects from his injuries, according to a spokesperson with the Department of Social Services.

The child, who was injured during what his mother described as "play wrestling," is now living with family members. His mother, 18-year-old Shakera Wright, is charged with allowing bodily injury to a child.

Wright told officers that three teens started wrestling with the child and that she made them stop when the hitting got too hard.

The incident happened at an apartment in the Ashley Shores complex in North Charleston.

Also charged was Tyrek Varnes, 16, of North Charleston along with a 14-year-old and a 15-year-old were all charged with infliction or allowing infliction to great bodily injury to a child. Varnes was charged as an adult.

In bond court in December, investigators revealed that the boy had been strung up by his ankles and beaten. Wright told investigators the incident happened the night of Nov. 29, but she didn't seek medical attention until the following morning, according to court documents.

The felony charge carries a 20-year sentence if they are convicted, said North Charleston Police PIO Spencer Pryor.

According to the incident report, Wright told DSS officials and a Medical University Hospital social worker she was visiting Varnes at his Ashley Shores apartment Nov. 29. The following morning, Wright left for school leaving her child with Varnes and two of his friends.

The three teens were "play wrestling" with the victim, the report stated. She made a boxing motion with both fists and indicated they were hitting the child in the chest and stomach. Wright told the DSS official she stopped it when she thought the boys were getting too rough.

According to the affidavit, Varnes admitted that he repeatedly hit the child. He also said he punched him with a closed fist, hung him upside-down in a closet by strapping a belt around his ankles, dropped him on the ground and then lifted the infant above his head and slammed him onto a bed.

Varnes told investigators it was possible the boy hit his head on a table.

However, Wright told the victim's grandmother she didn't know how the child had sustained the injuries and speculated the baby may have fallen, the report stated.

A forensic pediatrician at Medical University Hospital also interviewed Wright before police and DSS were called. According to his report, Wright said she put her child in bed with Varnes and went to bed in an adjoining room with Varnes' twin sister Monday night.

The following morning, she said Varnes' mother woke him up and he left for school. It was then Wright noticed her child was not playful and did not look well. According to her, he "looked like he wanted to die," she told the ICU doctor.

After several attempts to make the child more alert, Wright called EMS. The doctor noted in his report that the child arrived at the ER shortly after 10 a.m. Tuesday in respiratory distress.

At 11:30 a.m., the child was moved to the Intensive Care Unit where doctors noted bruising and swelling on the boy's chest, back and abdomen.

A CT scan revealed five rib fractures, air and blood in his thorax, multiple lacerations of his liver, spleen and pancreas. He was also in shock, the attending doctor stated in his report. The scans also showed the boy had fractured his skull at some point, but could not determine when that injury happened.

At that point, hospital officials called DSS and police, the report shows.

The skull fracture was corroborated by Wright's statement to police in which she said her child had been struck by Varnes when he stayed at the Ashley Shores apartment in the past.
